FOTH Engineering Report
Pre-Application Meeting:
Prior to the initiation of the permitting process, Foth will coordinate and attend a pre-application meeting with representatives from all regulatory agencies with jurisdiction at the project area to present and discuss the proposed work.
The intent of this meeting will be to gain an understanding of potential regulatory concerns so that such issues can be accounted for prior to filing permit applications and allow for a more efficient review.
This meeting will also allow for Foth to confirm the permit filings required for proposed project.
Boston Conservation Commission,
Notice of Intent:
Foth will prepare one (1) Notice of Intent filing and necessary supporting information for the project, and file the applications with the Boston Conservation Commission. Foth will attend up to two (2) public hearings for each filing, prepare and provide one (1) round of additional information requested by regulatory agencies,
and record the issued Order of Conditions at the Suffolk County Registry of Deeds.
Massachusetts Department of Environmental Protection (MassDEP) Chapter 91 Waterways License: Foth will prepare and submit a Chapter 91 Waterways
License application, permit plans and relevant site documentation to MassDEP. Foth will place the required public notice in the local newspaper and distribute copies of the notice and permit plans to all required local departments, state agencies and abutters by certified mail.
Foth will formally respond to agency/public comments received if requested to do so by MassDEP. Foth will record the MassDEP license documents at the Suffolk
County Registry of Deeds and provide proof of recording to
MassDEP as required.
US Army Corps of Engineers (USACE), Self-Verification: It is anticipated that the proposed project within the footprint of the existing pier structure will be eligible for USACE self-verification under the maintenance GP. Foth
will prepare/submit the self-verification form to the USACE
New England District Office for their information and
record.
Massachusetts Environmental Policy Act (MEPA):
Depending on the preferred project approach selected
by the BPDA the project may require an Environmental
Notification Form (ENF) and rollover Single Environmental
Impact Report (SEIR). The project area lies within proximity
to Environmental Justice (EJ) populations and new MEPA
protocols will be followed as necessary. If programs A or B
are selected, Foth will prepare, submit, and coordinate the
necessary filings with MEPA to obtain a Certificate for the
project.
National Park Service, Project Concurrence Foth will prepare and submit the proposed design information and supporting information to the National Park Service (NPS) as necessary for use in review of the project as it relates to their policies. Foth will coordination with NPS as necessary to allow the issuance of
concurrence for the proposed project.
Boston Landmarks Commission, Not Applicable: Pier 5 is not a listed landmark nor is it within a municipal historic district and therefore filing and coordination with the Boston Landmarks Commission is not anticipated or included in the scope of this proposal.
