ASM Global Partner Ticketmaster facing Antitrust Lawsuit filed by Federal and *40* States!


Ticketmaster is facing a major antitrust lawsuit filed by the U.S. Department of Justice and 40 states and the District of Columbia, which alleges the company, through its parent Live Nation, holds a monopolistic control over the live entertainment industry, from ticketing to venue ownership and concert promotion. The suit, spurred by the chaotic Taylor Swift concert ticket sale in 2022, seeks to break up Live Nation-Ticketmaster and restore competition for fans, artists, and venues by forcing a separation of the entities and eliminating anti-competitive practices.  

The Core Allegations

The lawsuit accuses Live Nation Entertainment and its subsidiary Ticketmaster of monopolizing key markets within the live entertainment industry, including: 

  • Primary Ticketing: Controlling a large majority of primary ticketing for major concert venues. 
  • Venue Ownership: Owning or controlling numerous large amphitheaters and venues. 
  • Concert Promotion: Holding a dominant share in concert promotion, especially for national tours. 
  • Secondary Ticketing: Exerting influence and a growing share of the secondary market. 

How Live Nation-Ticketmaster Allegedly Maintains Monopoly

  • Exclusionary Contracts:Using long-term, exclusive contracts to lock out competitors from venues. 
  • Threats and Retaliation:Threatening and retaliating against venues and artists who try to work with competitors. 
  • Cross-Subsidization:Using high-margin businesses to subsidize less profitable ones, creating a “flywheel effect” that entrenches its dominance. 
  • Barriers to Entry:Creating significant barriers for new competitors to enter and grow in the market. 

The Goal of the Lawsuit

The U.S. government and the states are seeking a “structural remedy,” which would involve breaking up the vertically integrated company to separate Live Nation and Ticketmaster. This would, in theory, restore competition to the market, leading to better outcomes for consumers through more innovation and lower prices, as well as better conditions for artists and venues.
